In a deeply troubling decision, the Trump-appointed majority on the
Supreme Court used the shadow docket to let the Trump administration
continue dismantling the Department of Education without congressional
approval. The case, McMahon v. New York, stems from Trump’s executive
order directing Education Secretary Linda McMahon to begin shutting down
the department, despite federal law requiring congressional action to do
so. Lower courts had blocked the move, but the Supreme Court stepped in
with no explanation to overrule them. In a forceful dissent, Justice
Sotomayor warned that the ruling undermines the Constitution’s separation
