Hi John,

I just got out of court where I was supporting my friend Zoe Rosenberg, an animal cruelty investigator and animal rescuer with DxE. She was arraigned this morning on her remaining charges, after her attorneys successfully argued that the evidence does not support a felony burglary charge and prosecutors conceded and dismissed that charge. Zoe's remaining charges are felony conspiracy and four misdemeanors including trespass and theft. All these charges stem from her rescue of four sick and suffering chickens at the Petaluma Poultry slaughterhouse in June 2023.

Today, the court confirmed Zoe's trial will begin May 16th. Judge Kenneth Gnoss set another hearing date of April 8th for defense attorneys to file a motion for the court to allow the affirmative defense of necessity in this case. After this motion is submitted, the court will set another date for it to be argued and decided before trial.

Zoe's lead attorney Chris Carraway, with the Animal Activist Legal Defense Project ( [link removed] ) , successfully represented another DxE animal rescuer who was acquitted ( [link removed] ) of theft charges in 2023 for rescuing a chicken from a slaughter truck in Merced County, CA. He says, “If Ms. Rosenberg had rescued a drowning dog from a neighbor’s pool, she would be applauded, not prosecuted. The fact is, California law does not distinguish between rescuing a dog from a pool and rescuing sick and injured chickens from a slaughterhouse. Those who profit off animal agriculture may not like it, but that is the law.”
