Earlier this month, President Biden announced an intention to move forward with a new immigration regulation that would deny asylum to migrants along the border. It could be announced as a formal regulatory proposal any day now.

The proposed asylum ban will have dangerous and lasting consequences. If formally announced and implemented, the Biden Administration’s Transit Ban would deny asylum to migrants encountered along the U.S. – Mexico border who transited through another country without seeking asylum there first or who entered between ports of entry.

Former President Trump and his Senior Advisor Stephen Miller tried to implement the same idea to get rid of our asylum system and ban migrants from entering the U.S. altogether. Multiple courts blocked versions of their Transit Ban because they were illegal.

Seeking asylum is legal and a human right.

If denied the opportunity to seek asylum, children and families fleeing violence, persecution and dangerous circumstances will be forced to return to these horrific conditions.

Instead of asylum bans, the Biden Administration can take other actions to make our asylum system stronger such as expanding avenues for asylum seekers to seek safety without having to embark on dangerous journeys to the U.S. border, working with, coordinating and supporting on-the-ground nonprofit organizations and local leaders who are welcoming new migrants, funding the asylum system so that it is more efficient while protecting due process rights and adopting a broader approach to immigration that addresses the need for visas, refugee admissions and efforts to address the root causes of forced migration.

It is crucial that President Biden and his administration understand that we should not send people back to danger by refusing to even hear their asylum claims.

Yes, legal pathways to enter the U.S. work, and we need more of them, but they are not a substitute for a functioning asylum system that allows people to go through a process to reach safety.
