In the final days of 2022, Colin and his colleagues used their last moments with Democratic control of the House to ensure that the Electoral Count Reform Act became law as part of the omnibus.
The Electoral Count Reform Act is a critical piece of legislation that works to ensure that January 6th will never happen again. Colin, who was on the House floor on the day of the insurrection, along with a bipartisan group of Senators, worked tirelessly to ensure the Electoral Count Reform Act became law.
The Electoral Count Reform Act includes several important reforms aimed at ensuring that a free and fair American election never comes as close to being overturned as it did on January 6, 2021. The legislation will make it far more difficult for a rogue state or governor to send a false slate of electors to Congress, which was part of the Trump team’s plan to overturn the 2020 election, and raises the threshold needed in Congress to object to a state’s results, so folks like Ted Cruz can’t do it alone in service of their personal political gain.
The Act also clarifies that the Vice President’s role in presiding over the certification of electors is purely ceremonial, and that he or she does not have any power to solely determine, accept, or reject electors. This was added in direct response to the pressure Vice President Mike Pence faced to reject the correct electors that would certify the victory for President Biden.
The reform also strikes down an archaic law that could potentially allow individual states to declare a “failed election” if they don’t like the results and override that state’s popular vote.
All of these reforms will strengthen our democracy and help to ensure that a crisis like January 6th never happens again. Colin was proud to help pass the Electoral Count Reform Act and will continue to do everything in his power to protect our democracy in this new Congress.
