NYC’s Floundering ‘Right to Counsel’ Fails to Keep Pace With Eviction Cases

New York City’s Right to Counsel law was the country’s first to promise legal representation to the tenants most at risk for eviction: low income New Yorkers.

But five years after its passage, the city’s trailblazing program is struggling meet demand. Legal service providers say they're overwhelmed by tenants' requests for an attorney since the state's COVID eviction moratorium ended a year ago. The Right to Counsel program had to decline some 10,000 cases since March 2022, with the courts scheduling eviction cases quicker than eligible tenants can access an available pro-bono housing lawyer.

"The court thinks that they can decide our caseloads. A lot of longtime practitioners are exhausted," housing attorney Cathy Barreda, above, a steering committee member of the Right to Counsel NYC Coalition.
