When the Supreme Court Dobbs opinion overturning Roe was leaked in May, Republicans focused exclusively on the leak of the opinion, trying to draw attention away from the harm their hand-picked right-wing justices were perpetrating on the American people.

Judiciary Committee Republican Andy Biggs called the Dobbs leak “an unprecedented and disgusting breach.”

Judiciary Committee Republican Louie Gohmert said, “The leak was designed to solicit threats & protests against the justices…”

Judiciary Committee Republican Darrell Issa said, “The leaking of a Supreme Court draft opinion is a betrayal of trust.”

So Republicans should be very interested in investigating a leak of yet another Supreme Court opinion, correct?

Not if that opinion was leaked by a conservative justice.

We now have evidence that the far-right Justice Samuel Alito allegedly leaked the anti-choice Hobby Lobby case in 2014, which allowed companies to deny reproductive health coverage to their employees. And what do Republicans say?

They spent last week trying to make excuses for Alito and attack the witnesses who were trying to warn Congress about the Hobby Lobby leak.

The fact is, without a code of ethics, Supreme Court justices are free to wine and dine with lobbyists and leaders of influence campaigns who try to affect the outcome of cases. These are the circumstances in which Alito allegedly leaked the Hobby Lobby opinion.

We need to shine a bright light on the gifts and contributions to justices, which is why Hank has introduced the Supreme Court Ethics, Recusal, and Transparency Act (SCERT) — to implement a code of ethics for the Supreme Court, to standardize recusal procedures, and to disclose justices’ gifts and travel.
