October 8, 2022 Update: While A Voice for Choice Advocacy's lobbyists and legislative team worked within the Capitol, your individual efforts also had a significant impact and helped to change the course of legislation this year - whether you sent emails to or called your legislators, met with staffers, gave public comment at local school board or county board of supervisor meetings, sent postcards to the Governor, donated money to A Voice for Choice Advocacy to support our legislative team or any combination of these. The impact was felt even for the "Bad" bills Governor Newsom signed, which were either significantly amended to water them down and/or which included a signing statement clearly indicating he understood our concerns.

Back in October 2021, A Voice for Choice Advocacy alerted you that there would be at least 6 "Bad" bills introduced in 2022 Caliofrnia this year. In the end, 11 "Bad" bills and 6 "Good" bills were introduced that fell within A Voice for Choice Advocacy's mission. Below is a full legislative summary for the 2022 California bills that A Voice for Choice Advocacy and you worked hard to support and oppose. ✘ 2022 CA BAD Bills ✘

A Voice for Choice Advocacy Actively Opposed the following bills:

✘ SB 1479 COVID-19 testing in schools: COVID-19 testing plans (Pan) – Testing programs for teachers, staff, and pupils: From January 1, 2023 until December 31, 2025 each public school district, county office of education, and charter school will be required to create, and post on their website, a COVID-19 testing plan that is consistent with guidance from CDPH or adopt CDPH’s framework. Note: It is the PLAN that is required, not testing. However, if the CDPH guidance requires testing, then testing will be required of public school children, staff and teachers. Another note: This is not required of private schools. ( [link removed] [[link removed]] )
AVFCA Position: Opposed.
Status: Signed by Governor. Becomes law starting January 1, 2023 until December 31, 2025.



✘ AB 1797 Immunization registry (Weber) - Modernize California’s Immunization Registry : Beginning January 1, 2023, all vaccines administered in California - past (as feasibly possible), present and future - will be required to be entered into the CA Immunization Registry (CAIR), causing huge privacy issues for those who do not want their personal medical information in a government database. Unlike consumer databases, government databases are not covered by the CCPA and so there is no way for private consumers, nor undocumented immigrants, to opt out. California is pushing to be the sanctuary state for health rights – abortion, transgender treatment, etc – but is forcing those who want medical privacy to get themselves and their children vaccinated out of state so there is no way their personal information will be hacked or leaked. ✘ AB 2098 Physicians and Surgeons: Unprofessional Conduct (Low) – MD/DO Misinformation : Starting January 1, 2023, in California, Medical Doctors and Osteopathic Doctors will be disciplined for unprofessional conduct if they "disseminate misinformation or disinformation related to COVID-19, including false or misleading information regarding the nature and risks of the virus, its prevention and treatment; and the development, safety, and effectiveness of COVID-19 vaccines." Misinformation is defined as "false information that is contradicted by contemporary scientific consensus contrary to the standard of care." With the ever mutating variants, changing vaccine efficacy and influx of treatments, there cannot be “contemporary scientific consensus” or “standard of care” for COVID for many years to come. AVFCA Position: Opposed.
Status: Signed by Governor. Becomes law starting January 1, 2023. While Governor Newsom's signing statement ( [link removed] [[link removed]] ) makes the bill sound narrowly tailored, his letter holds no weight in front of the Medical Board or a court of law, and therefore is just lipstick on a pig. Physicians and Surgeons are going to be stifled in their practice, and innovation and medical advancements will be all but dead when it comes to COVID-19 science in California. Californians have witnessed this happen with Medical Exemptions for Vaccines, where doctors have been witch-hunted for going against the standard of care, even if their medical opinions are backed up by scientific evidence.



✘ SB 1419 Health Information (Becker) – Prohibits representatives of minors, age 12 years and older, from inspecting minors’ patient records that relate to sensitive medical services: While SB 1419 on its face is a bill that A Voice for Choice Advocacy would normally support, as it strengthens the privacy of the sharing of medical records, this bill also prohibits representatives of minors, age 12 years and older, from inspecting minors’ patient records that relate to sensitive medical services the minor has consented to without their parent or guardian's consent. These may include medical care related to the prevention or treatment of pregnancy, mental health treatment, drug and alcohol treatment, the treatment or prevention of STDs and/or the treatment of infectious diseases. This bill would force California parents to endure the unnecessary burden/cost of litigation in an attempt to subpoena/obtain their child’s medical records. ( [link removed] [[link removed]] )

✘ SB 866 Minors: vaccine consent (Wiener) – 15 Year Old Minor Consent to Vaccination Without Parental Consent : A minor 15 years of age (amended up from 12) or older may consent to a vaccine that is approved by the United States Food and Drug Administration and meets the recommendations of the Advisory Committee on Immunization Practices (ACIP) of the federal Centers for Disease Control and Prevention (CDC) w ithout the consent of the parent or guardian of the minor. ✘ AB 1993 Employment: COVID-19 vaccination requirements (Wicks) :
Mandates employers to require each person who is an employee or independent contractor, and who is eligible to receive the COVID-19 vaccine, to show proof to the employer, or an authorized agent thereof, that the person has been vaccinated against COVID-19 . ( [link removed] [[link removed]] )

✘ SB 871 Public health: immunizations (Pan) : DayCare Vaccine - mandates vaccines for school children absent any legislative process, allowing school health directors to add any vaccine to the requirement list moving forward. ( [link removed] [[link removed]] )

✘ SB 1464 Law enforcement: public health orders (Pan) : Requires sheriffs and peace officers to enforce all orders of the State Department of Public Health, or of the local health officer issued, for the purpose of preventing the spread of any contagious, infectious, or communicable disease. Status: Di ed upon introduction in Senate Health Committee.



✘ SB 920 Medical Board of California: investigations: record requests (Hurtado) : Would authorize a medical board investigator and a medical consultant, at the discretion of the board, to inspect the business location and records of a physician or surgeon, including patient and client records, without patient’s consent, circumventing HIPAA, which requires healthcare providers to protect sensitive patient health information from being disclosed without the patient’s consent or knowledge. ✘ AB 2539 Public Health: Covid vaccination: proof of status (Choi) : Public or private entities requiring members of the public to provide documentation regarding vaccination status for any COVID-19 vaccine as a condition of receipt of any service or entrance to any place that can accept a written medical record or government-issued digital medical record in satisfaction of the condition, as specified. ⇄ SB 1184 Confidentiality of Medical Information Act: school-linked services coordinators (Cortese) : Health care providers and health care service plans would be authorized to disclose medical information to a school-linked services coordinators. ✔ AB 1809 Nursing Facility Resident Informed Consent Protection Act of 2022 (Aguiar-Curry) :
Requires the right of every resident to receive all information material to an individual’s decision concerning whether to accept or refuse any proposed treatment or procedur e, along with possible nonpharmacologic approaches that could address the resident’s needs, and how a facility and prescriber will monitor and respond to any adverse side effects, and inform the resident of side effects. ✔ SB 1149 Civil actions: agreements settling actions involving public health or safety (Leyva): Prohibits a provision within a settlement agreement for civil damages regarding a defective product or environmental condition that poses a danger to public health or safety, as defined, that purports to restrict the disclosure of factual information related to the action. Status: Died in Assembly Judiciary Committee.



✔ SB 994 Vocational nursing: direction of naturopathic doctor (Jones): Revises the definition of vocational nursing to additionally include practice under the direction of a naturopathic doctor. ( [link removed] [[link removed]] )

Status: Signed by Governor. Becomes law starting January 1, 2023.



✔ AB 2146 Pesticides: midacloprid, clothianidin, thiamethoxam, dinotefuran, and acetamiprid: prohibited nonagricultural use (Bauer-Kahan): Designates, by regulation, pesticides containing midacloprid, clothianidin, thiamethoxam, dinotefuran, or acetamiprid as restricted materials, and prohibits, beginning January 1, 2024, the sale, possession, or use of these pesticides, except for use on an agricultural commodity, as defined. ✔ AB 1817 Product safety: textile articles: perfluoroalkyl and polyfluoroalkyl substances (PFAS) (Ting): Beginning January 1, 202 5 , prohibits any person from distributing, selling, or offering for sale in California any textile articles that contain regulated PFAS, and requires a manufacturer to use the least toxic alternative when replacing regulated PFAS in textile articles to comply with these provisions. ✔ AB 2771 Cosmetic products: safety (Friedman): Prohibits a person or entity from manufacturing, selling, delivering, holding, or offering for sale in commerce any cosmetic product that contains intentionally added perfluoroalkyl and polyfluoroalkyl substances PFAS.
