Supreme Court Rules Yeshiva University Must Comply with New York Court Ruling for Now
 
Yeshiva University in New York City applied for an emergency stay to the Supreme Court from a New York state trial court order, requiring the university to provide space at a student fair for Pride Alliance, an LGBTQ student group. The trial court ruled that because the university was considered a public accommodation, it was covered under the New York City Human Rights Law and is required to provide the Pride Alliance the same access to facilities as other student groups.
 
Yeshiva University requested the stay [ [link removed] Application FINAL.pdf ] while it appealed the trial court’s decision because “it was a deeply Jewish religious school,” whose religious beliefs would be violated if it followed the court order. Prior to appealing to the Supreme Court, Yeshiva lost a stay request at the New York State Court of Appeals. The Pride Alliance argued in its filing at the Supreme Court [ [link removed] Supreme Court Brief FINAL 2pm Friday.pdf ] opposing the requested stay that “this ruling does not touch the University’s well-established right to express to all students its sincerely held beliefs about Torah values and sexual orientation.” At the same time, the filing adds, “it may not deny certain students access to the non-religious resources it offers the entire student community on the basis of sexual orientation.”
 
Justice Sonia Sotomayor initially granted the stay [ [link removed] ] on Friday, Sept. 9. However, the Justice’s order noted that the order was “pending further order of the undersigned or of the Court.”
 
Last week, the full Supreme Court reversed [ [link removed] ] its decision on a 5-4 vote, saying that the university should comply with the New York state court while its appeal moves through the court system. The Supreme Court noted that Yeshiva University had other avenues that it had not yet exhausted regarding its request. Once those are exhausted, Yeshiva could again bring its case to the Supreme Court.

Biden Appoints First Director of ARPA-H
 
President Biden appointed [ [link removed] ] Dr. Renee Wegrzyn as the Director of the Advanced Research Projects Agency for Health (ARPA-H).
 
Dr. Wegrzyn holds doctorate and bachelor’s degrees in applied biology from the Georgia Institute of Technology, was a fellow in Johns Hopkins University’s Center for Health Security Emerging Leaders in Biosecurity Initiative and completed her postdoctoral training as an Alexander von Humboldt Fellow in Heidelberg, Germany. She served on the scientific advisory boards for the National Academies of Sciences’ Board on Army Research and Development, Revive & Restore, the Air Force Research Labs, the Nuclear Threat Initiative and the Innovative Genomics Institute.
 
She is currently Vice President for Business Development at Ginkgo Bioworks and the Head of Innovation at Concentric by Ginkgo, the company’s initiative to advance coronavirus testing and to track the spread of the virus. Dr. Wegrzyn also worked at the Defense Advanced Research Projects Agency and its sister agency, the Intelligence Advanced Research Projects Activity.
 
Dr. Wegrzyn begins her new role as Director of ARPA-H on Oct. 1 and will report directly to the Secretary of the Department of Health and Human Services.

Trudeau Shares More About First Phase of Canadian Dental Plan
 
Canadian Prime Minister Justin Trudeau recently announced additional details [ [link removed] ] about the first phase of Canada’s national dental plan. The initial phase of the plan will provide up to $650 (CAD) annually for dental expenses to parents of children under age 12 who do not have access to dental insurance and meet income requirements. Annual amounts begin to phase out for families with incomes above $70,000 (CAD) and phase out completely for families with incomes of $90,000 (CAD) and above. In addition to lacking access to dental insurance, eligible families will also need to have out-of-pocket dental care expenses and provide receipts to verify those expenses.
 
While the first phase only provides funds for children under age 12, it is expected that seniors, children under age 18 and people living with disabilities will be eligible by 2023. Full implementation is expected to occur in 2025 and would extend coverage to all families with incomes below $90,000 (CAD).

Delaware Governor Signs Bill to Address Dental Care Access for Underserved Communities, Licensure and Other Issues
 
On Aug. 30, Delaware Gov. John Carney (D) signed a bill [ [link removed] ] that would create Dental Care Access Task Force. The Task Force would consist of designated stakeholders and would be required to examine:
 • Dental care access, including for underserved populations and communities,
 • Dental licensure practices and requirements,
 • Dental provider type and scope of practice,
 • Dental provider recruitment and retention strategies and
 • Dental insurance networks and coverage, including for the uninsured and underinsured.

The Task Force would be required to submit its report no later than Feb. 1, 2023.
 
Additionally, the bill increases licensure portability for dentists who apply for a community health license to care for underserved populations. These licenses require the individuals who hold them to work in a federally qualified health center or government-operated dental clinic. The bill would allow an individual to obtain a community health license by passing a nationally recognized regional board exam, rather than the Delaware Practical Board Exam, and would create a pathway to full licensure.
