Today, I was joined by Senators Lisa Murkowski, Susan Collins, and Kyrsten Sinema in introducing bipartisan legislation to codify Roe v. Wade’s protections into law.

The legislation, called the Reproductive Freedom for All Act, would enact the essential holdings of Roe v. Wade and protect a woman’s right to abortion and contraception, undoing the damage of the Supreme Court’s decision overturning Roe.

Here’s why: After the Supreme Court gutted a woman’s right to make her own health care choices, it is incumbent upon Congress to take action to restore that right.

This effort will do just that, and I’m proud to join with my Republican and Democratic colleagues to introduce this federal legislation.

I believe the Supreme Court’s decision to overturn Roe in Dobbs v. Jackson Women’s Health goes directly against not only the Constitution and legal precedent, but also the will of the majority of Americans.

Because it does. 

According to a recent Pew Research poll, more than 60% of Americans believe abortion should be legal in all or most cases.

Overturning Roe has resulted in immediate bans on all abortions in several states. It has also jeopardized many other essential rights, including the right to access birth control, which was outlined in Griswold v. Connecticut and other cases.

Here’s what else our bill would do:

  • Prohibit state bans that impose an undue burden on a woman’s access to pre-viability abortions while allowing states to enact reasonable restrictions on post-viability abortions – provided that states cannot ban abortions that are necessary to protect the life or health of the mother.
     
  • Protect access to contraceptives.
     
  • Allow individuals adversely affected by a state abortion restriction to challenge it in court.
     
  • Require states to pay the challenger’s attorney fees if the challenge against the state is successful.

These are fair, commonsense protections that all women deserve. And I’m proud to introduce this legislation. But I need you with me. So please, add your name today and send a message that reproductive rights must be protected.
