If you’ve seen the headlines about yesterday’s oral arguments on Texas’ SB 8 at the Supreme Court, you might think that Amy Coney Barrett and Brett Kavanaugh were about to soften their anti-choice ideology.

But let’s not be fooled. Barrett and Kavanaugh’s reservations about Texas’ law have nothing to do with the fact that it attacks reproductive freedom and deprives Texans of their constitutional right to abortion.

They are only concerned about how SB 8’s vigilante-style enforcement scheme might be weaponized to attack other rights they do care about.

The anti-choice supermajority on the Supreme Court is unmistakably hostile to abortion, and Barrett and Kavanaugh are no exception. We can’t afford to underestimate the threat reproductive freedom faces. We need to be ready to fight back.

Barrett and Kavanaugh’s confirmations were catalysts for the anti-choice movement’s recent barrage of attacks on abortion access. It is no coincidence that lawmakers hostile to abortion escalated their all-out assault on reproductive freedom after the justices’ confirmations, paving the way for the enactment of more than 100 state-level restrictions on abortion access this year alone .

NARAL and its 2.5 million members are building support for the Women’s Health Protection Act (WHPA), a bill that would protect the right to abortion throughout the country—even if Roe is overturned. It has already passed the House and our focus is now on ensuring the Senate acts to pass this crucial legislation. But we need resources to make it happen.
