Death of a family member is doubly tragic for a noncitizen whose future immigration status depends on that family member. This webinar will describe three possible ways that the noncitizen can try to continue or begin that benefit application despite the death of the relative. INA Section 204(l) can help certain people who are residing in the U.S. at the time that the sponsoring or principal beneficiary relative dies; widow/widowers of U.S. citizens have a special provision that can allow them to self-petition and apply for permanent residence or convert a pending spouse petition; and USCIS has the discretion to revive a petition under humanitarian reinstatement in some cases.
