Dear John:
Tenants have won a nationwide eviction moratorium that will go into effect on Sept. 4th and last through December 31st, 2020, per the CDC.
The moratorium will cover tenants who fall into one of these categories:
-
expect to earn less than $98k individually or $198k as a household this year;
-
received a stimulus check; OR,
-
were not required to report income in 2019.
Tenants must declare their inability to pay via a CDC form to their landlord. The form can be found HERE.
The moratorium DOES NOT protect tenants from:
-
being evicted for reasons “other than nonpayment of rent”
-
being charged “fees, penalties, or interest as a result of the failure to pay rent or other housing payment on a timely basis”
We will need to organize to make sure our neighbors know about this new protection. We will also need to remain vigilant about retaliation and illegal evictions.
This is a huge victory for tenants who have fought to stay in their homes in the face of the coronavirus pandemic, but we must continue to fight for rent and mortgage cancellation (#CancelRent) through the end of the pandemic. No payments, no late fees, no debt. There’s no other option.
Sincerely,
Tara Raghuveer
