On March 5th, 18 courageous children and youth will stand before the Ninth Circuit Court of Appeals, challenging a federal agency whose policies treat children’s lives as worthless.
The youth plaintiffs argue that the EPA, the very agency charged with protecting children’s health and welfare, has systematically discounted the economic value of their lives and their future when determining how much climate pollution to allow. By doing so, the government is violating their constitutional rights to equal protection of the law, including their fundamental right to life.
The young plaintiffs are already living with decades-long consequences of these economic and pollution policies, including extreme heat, wildfire smoke, asthma attacks, evacuations, displacement, and exposure to dangerous air pollution.
At the hearing, the court will hear arguments that children are uniquely protected under the Constitution and that the EPA’s actions unlawfully sacrifice children’s lives and health in favor of economic interests of adults today who profit off of fossil fuel pollution. They’re asking the Ninth Circuit to reinstate their case and rule that courts have a duty to hear constitutional claims brought by children whose lives and rights are harmed by government policies.
