TPS Update: Disappointing Ruling in NTPSA II v. Neom

February 10, 2026

Adhikaar is deeply disappointed with yesterday’s ruling on the NTPSA ll vs. Neom from the Ninth Circuit Court of Appeals for granting the Trump administration’s request for a stay for the second time. This ruling allows the Department of Homeland Security (DHS) to move forward with the termination of Temporary Protected Status (TPS) for individuals from Nepal, Honduras and Nicaragua.
Thousands of immigrants who have made the U.S. their home will risk detention and deportation.

This ruling threatens the stability, safety, and dignity of Nepali, Honduran, and Nicaraguan TPS holders' families who have built their lives, raised their children, and contributed to the U.S. economy for decades. Stripping away hard-won protections from lower courts does not reflect American values. This decision will heighten the fear and instability for so many families.

While this outcome is painful, Adhikaar will keep on fighting.

We will continue to host monthly legal clinics, Know Your Rights, and Safety Planning Sessions. We will also work with our partners in New York to ensure that the city remains a haven for all and build our community defense locally. We will work with legal service providers and community groups around the country serving Nepali-speaking communities. We are here for TPS holders.
