Washington, DC – ConservAmerica is pleased to announce the release of its latest report Powering America: Reforming the ESA to Recover Species and Build Infrastructure. ([link removed])

This report offers a comprehensive analysis of project litigation from 2005-2025 for 17 major fossil fuel projects with at least $500 million in capital investment, over two-thirds of which were subject to litigation under the Endangered Species Act (ESA), the National Environmental Policy Act, (NEPA), or the Clean Water Act (CWA). ESA challenges proved to be particularly fatal to projects.

“Environmental activists have increasingly weaponized the Endangered Species Act to halt otherwise beneficial energy projects, even though a fraction of the billions lost to litigation-driven delays could fully recover the affected species,” said Brent Fewell, ConservAmerica General Counsel. “This study highlights the urgent need for Congress to enact durable, proactive funding and statutory safe harbors that curb legal abuses, provide greater certainty for developers, investors, and landowners, and incentivize species recovery on private lands, where nearly 80% of at risk species occur.”

Approximately 40% of all major projects challenged under ESA were ultimately canceled or indefinitely delayed. Those impacted projects represent tens of billions of dollars in sunk costs and lost investment, thousands of construction and operations jobs never realized, and the loss of substantial tax revenues for local and state governments, not to mention the effect on the country’s energy security.

Recognizing that without Congressional action, the ESA will continue to affect national infrastructure, ConservAmerica offers four recommendations to de-risk development, provide regulatory certainty, and achieve superior conservation outcomes at a fraction of the current economic cost:
1. Provide stable, predictable funding for State and Tribal wildlife agencies
2. Establish a statutory safe harbor for compensatory mitigation.
3. Create market-based habitat recovery tax credits for private landowners.
4. Scale private-lands species recovery through the National Fish and Wildlife Foundation.
