Let’s set the scene:
It’s January. The beginning of a midterm election year. Tons of wins in 2025 elections show — we could see a wave election where control of Congress flips.
And the Supreme Court is poised to upend the rules of the game.
We’re talking about January 21, 2010 — 16 years ago today, when five right-wing justices ruled that corporations could spend unlimited sums to elect politicians who would do their bidding.
The case? Citizens United v. FEC , of course.
Now, at the start of another critical midterm election year, the Supreme Court looks ready to hit our democracy with another major decision in Louisiana v. Callais.
If they gut Section 2 of the Voting Rights Act, Republican state legislatures could draw new racially discriminatory voting maps — and many are openly preparing to do so. Those new maps could deprive Black and brown Americans of any real chance at electing the candidates of their choice in hundreds of congressional and state legislative districts.
And depending on the timing of the ruling, new maps could be in effect this November.
In both Citizens United and Callais , the Supreme Court took the rare step of asking for a case to be re-argued — a typical indicator that a landmark ruling could be on the way.
And Callais could follow in Citizens United’s footsteps by once again making it harder for voters to make their voices heard in our democracy — once again allowing politicians and their wealthy donors to consolidate their own power without worrying about true accountability from the American people.
If we could go back in time to before the Citizens United ruling, we’d do everything we could to shore up our democracy against corporate control. We don’t have a time machine — but we can, and must, act now before another potentially devastating ruling.
