Florida is one of only two states that don’t require a unanimous decision to impose a death sentence. But if Ernest was tried today, he would not be sent to death row. In 1992, Ernest was sentenced to death by a non-unanimous jury vote of 7 to 5. Today, Florida law requires at least 8 jurors to vote for death. Regardless of the jury vote, Ernest should never have been convicted. He should not be on death row. He should not be executed. Since the beginning of last year, Florida has rushed to execute people at an unprecedented rate. They ignored pleas from victims' families and the discovery of new evidence. Just like in Ernest’s case. We need your signature to remind state officials what a huge mistake it was to send Ernest to the row—and what they can do to fix it.
