As you know from my prior updates, Judicial Watch will
be going back to the Supreme Court in 2026 for
another landmark case – This one to challenge
Mississippi’s lawless practice of counting ballots received up to
five days after Election Day.
At the heart of this case is a simple question: When is an
election really over?
We addressed the question in our recently filed opposition to the cert
petition (Brief in Opposition) with the Supreme Court which states:
“Federal law sets Election Day as the first Tuesday after the
first Monday in November.”
And that Congress made the law of the land perfectly clear that there is
to be a single national Election Day.
“In passing the Election Day statutes, Congress sought
‘uniform[ity]’ in ‘holding all elections for Congress and
the Presidency on a single day throughout the
Union.’”
When states overreach by extending ballot receipt far after the allotted
day, they not only disobey federal law.
They also erode public confidence in our elections.
While we’re incredibly proud to fight for election integrity at
the Supreme Court, it’s important for you to know this is

(FOIA) lawsuits which help expose corruption at the federal, state, and
local level.
