Last night, Trump announced that he was pardoning Tina Peters, who was convicted by a jury of her peers, for state crimes, in state court, and is currently serving her sentence of 9 years of incarceration.

The big problem: a president does not have the authority to issue pardons for state crimes and convictions. Trump’s pardon proclamation comes after his recent unsuccessful request to transfer Peters from state prison to federal custody.
Jena said, “Trump has no constitutional authority to pardon Peters. His assault is not just on our democracy, but on states’ rights and the American Constitution.”
