MAJOR VICTORY — America First Legal Wins Lawsuit Against Fairfax County Public Schools for Telling a Girl to Share the Restroom with a Boy

Taking on the largest school district in the Commonwealth of Virginia, America First Legal secured a significant victory against Fairfax County Public Schools (FCPS) this week, sending a clear message that AFL will not stand by as radical gender policies are imposed on school children across the country. This case surrounded a female student who was told she must leave the girls’ restroom if she felt unsafe when a male was present in the girls’ bathroom. Following AFL’s filing against FCPS in federal court, FCPS conceded, and the federal court awarded judgment, nominal damages, and fees to AFL’s client.
This outcome sends a powerful message that schools cannot trample students’ safety, privacy, or constitutional rights to advance their radical agenda. The court’s judgment comes as families nationwide confront school districts determined to impose ideologies that violate the U.S. Constitution and federal law, rendering this win an important step toward restoring reasonable restroom and locker-room policies. America First Legal will continue to fight for and defend the rights of America’s children and parents when school districts violate these federally protected rights.

America First Legal Stands With Trump Administration, Asks the Court to Allow President Trump’s Deployment of the National Guard to Continue in Washington, D.C.

America First Legal, alongside co-counsel, has filed an amicus brief urging the D.C. Circuit to immediately reverse a district court ruling that would pull National Guardsmen out of Washington, D.C. AFL’s amicus brief makes clear that the President has the unquestionable constitutional and statutory authority to protect public safety by deploying the National Guard in the federal district. The district court’s ruling to the contrary jeopardizes the dramatic public-safety gains achieved by the guard over the past several months, including cutting violent crime nearly in half, dropping carjackings to their lowest level since 2020, and restoring the confidence of D.C. residents to move safely across the city and to once again trust law enforcement.
Even Mayor Bowser has acknowledged the guard’s role in driving an “extreme reduction” in violent crime, despite the City Attorney General’s political grandstanding and misleading claims of a “military occupation.” America First Legal will continue to defend the lawful authority of the President to defend public safety and otherwise carry out his duties under the Constitution.

The little-noticed update on the court docket means the district will pay nominal damages of $50 and Doe’s accrued attorney’s fees.
The public docket filing indicates that America First Legal accepted the offer of judgment. The court must still approve and enter judgment before the case is formally resolved.”
