Both AVFCA's Religious Exemption and Titer Testing
for School Vaccine Requirements Lawsuits are Moving Forward!

A Voice for Choice Advocacy has two of the most important lawsuits in California today - cases that have the greatest potential to restore the ability for children to attend school without being fully vaccinated, and to re-establish constitutional protections that were stripped away under SB 277. These lawsuits are chipping away at unconstitutional barriers...and they are advancing.

No matter what happens nationally or politically, even with strong leadership from those like President Trump or RFK Jr. who promise to Make America Healthy Again, it will take lawsuits like these to return our rights here in California. AVFCA is leading that fight.

Below are the latest updates on each case, and how you can help us keep this momentum going.


🙏 SB 277 Religious Exemption Lawsuit — Ninth Circuit Briefing Underway

Earlier this year, the trial court dismissed our case - as expected - which moved us into the venue where this case was always meant to be won: the Ninth Circuit Court of Appeals.

We are now fully in the briefing process:

Opening Brief filed: October 8, 2025
Answering Brief due: on or before December 10, 2025
Reply Brief due (our final word): on or before December 31, 2025

Our attorneys will review the government’s arguments and respond with a strong Reply Brief. The constitutional grounds for religious protection and the unequal treatment between secular and religious exemptions make this case one that judges must take seriously. We are prepared to continue all the way to the U.S. Supreme Court if necessary.

🧬 Cannistra Titer Testing Lawsuit — Court Hearing Set for Feb. 13, 2026

This case has already achieved a key win: the Court agreed our claim for administrative mandamus review must move forward. That means CDPH’s denial of a medical exemption, despite documented immunity, is now subject to judicial review.

There is a challenge at this stage: The Court may only review the existing administrative record, i.e. no new evidence can be added. Our attorneys are meeting with opposing counsel now to confirm the full record and ensure that every piece of evidence CDPH relied on is included and scrutinized.

Most importantly: The Court will hear and try this case on February 13, 2026.

A victory here would bring science-based recognition of titer testing as proof of immunity for school attendance, just as most other states and CA’s own university systems already do.

Thus far these cases have cost over $150,000, and we have a long way to go!
