Know Your Rights: Five Things Parents Detained by ICE Should Know
Parents and legal guardians detained by Immigration and Customs Enforcement (ICE) have the right to make decisions about their minor child’s care from the point of arrest to before deportation, even from inside ICE detention; and if they have a case with their state welfare authorities, parents and legal guardians also have the right to stay involved in that case. Because ICE does not always honor people’s rights and the immigration landscape can change quickly, this fact sheet (available in Spanish and English) presents five things parents should know about their rights under the ICE detained parent directive and how to ask for them.
