The Department of Environmental Quality has revised Water Quality Rules, Chapter 28, Standards for Issuing Permits for Commercial Oilfield Waste Disposal Facilities.
The revisions to Chapter 28 (1) clarify existing freeboard design requirements to ensure compliance with the Environmental Quality Act and to ease confusion at the application stage; (2) add notification requirements to the existing leak detection paragraph that correspond with certain leakage rates; (3) narrow the applicability of public notice requirements and clarify that the public participation requirements apply to new permits and specific permit modification situations; (4) update the list of referenced materials to include recently adopted standards; and (5) update cross-references, update formatting and style, and correct grammar and punctuation errors throughout the Chapter.
The Environmental Quality Council adopted the revised rules at a public hearing held on September 17, 2025, in the Eastern Wyoming College Board Room, 3200 West C Street, Torrington, WY 82240. The final rule was filed with the Wyoming Secretary of State on November 13, 2025.
