But Congress is resurrecting the ban. Reports indicate that House Leadership is trying to jam through a similar provision in this year's National Defense Authorization Act (NDAA) package that would prevent states from protecting their citizens from emerging AI risks, leaving young people and families vulnerable.

Add your name to a letter telling key Congressional House and Senate Armed Services leaders why you oppose the provision and urge them to publicly reject the addition of any AI preemption provision to the NDAA.

If passed, this would mean that even if a company deliberately designs an algorithm that causes harm, the company making or using the harmful design would be unaccountable to the public and to lawmakers. And in states with robust AI safeguards, legislation like California’s SB-53 or hard-fought kids' safety bills like the Vermont Age-Appropriate Design Code risk being rendered null and void.

States should retain the right to protect their citizens from potential AI-related harms, especially given what we've learned from social media's impact on young people when oversight was lacking.
