America First Legal Exposes Critical Flaw in Gavin Newsom’s and the State of California’s Lawfare Against President Trump |

Following the State of California’s lawfare challenging President Trump’s Executive Order 14168, “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government,” AFL initiated an investigation to learn whether California actually has standing to bring its lawsuit. California had sued the administration to allow biological men in women’s sports, and our investigation has now revealed that California may lack sufficient evidence to support its lawsuit.
AFL’s findings follow multiple public records requests to California agencies seeking documentation of harm related to transgender participation in sports. AFL has received no responsive records. In fact, the Civil Rights Department and California Interscholastic Federation both stated they had no relevant data or complaints, and the Department of Education has not responded. This lack of evidence raises questions about whether California has the legal standing necessary to pursue its case.

America First Legal Files Brief at U.S. Supreme Court Supporting President Trump’s Invocation of Presidential Emergency Authorities to Impose Tariffs, Protect American Workers |

America First Legal filed an amicus brief with the U.S. Supreme Court supporting President Trump’s use of the International Emergency Economic Powers Act to impose tariffs on foreign goods. AFL’s brief, submitted in concert with co-counsel and Members of Congress, is in connection with two consolidated cases that challenge the President’s authority to use tariffs under national security grounds.
AFL argues that Congress explicitly granted the President this power, which is fully consistent with the U.S. Constitution and does not violate constitutional principles, such as the separation of powers. Therefore, the courts should not interfere in executive decisions involving national emergencies and foreign affairs, which fall under core presidential authority.

America First Legal Files Federal Civil Rights Complaint Against Ohio Northern University for Unlawful Discrimination in Hiring and Admissions Processes |

Continuing our efforts to eradicate violations of federal civil rights laws regardless of where they exist, AFL filed a federal civil rights complaint with the Department of Education’s Office for Civil Rights against Ohio Northern University (ONU), alleging ONU violated Title VI and Title IX by using race and sex as factors in faculty hiring and student admissions.
The complaint highlights statements from ONU that suggest racial and gender considerations influence decisions, including efforts to hire more Black adjunct faculty and maintain a consistent gender balance in the student body. These actions reflect discriminatory quotas and unlawful preferences, rather than genuine inclusion. ONU’s DEI initiatives and targeted scholarships for “diverse” applicants further evidence of the University’s illegal practices, which must be stopped.

America First Legal Challenges Adrian Fontes’ Illegal Election Rulemaking Power Grab, Defends Arizonans’ Right to Provide Input on Election Rules |

AFL filed an amicus brief with the Arizona Supreme Court in support of the Republican National Committee in its case against Arizona Secretary of State Adrian Fontes. The case challenges Fontes’ decision to cut the public comment period for the state’s Elections Procedures Manual (EPM) in half, allegedly violating Arizona law and limiting public input on critical election rules.
Fontes’ actions undermine the transparency and accountability required by the Arizona Administrative Procedure Act and the EPM statute. AFL is urging the court to block this unlawful attempt to unilaterally rewrite election procedures.

“A legal watchdog founded by a top Trump confidant provided records to Fox News Digital that it says show California lacks standing in its latest lawsuit against the administration.
America First Legal filed public records requests with the State of California demanding proof it is being harmed – in a legal sense — by President Donald Trump’s executive order requiring schoolchildren to compete in sports leagues matching their biological sex.
The watchdog – founded by White House Deputy Chief of Staff Stephen Miller – provided letters from an attorney representing the state as well as the California civil rights apparatus, denoting that no records could be found for their multiple inquiries.”

“The Trump administration announced on Wednesday the launch of a civics education coalition that includes the Education Department and more than 40 partner groups, all of which are closely aligned with the president’s Make America Great Again movement.
The groups in the civics coalition include America First Legal, a group founded by Stephen Miller, the architect of Mr. Trump’s policy agenda.”
