QUOTE OF THE WEEK
“Too often, Section 2 is deployed as a form of electoral race-based affirmative action to undo a State’s constitutional pursuit of political ends. That misuse of Section 2 is unconstitutional.” – The U.S. Department of Justice in an amicus brief [ [link removed] ] urging the Supreme Court to “devastate and vitiate” Section 2 of the Voting Rights Act.
NOTABLE TRENDS
DOJ Urged Supreme Court to Gut Section 2 of the Voting Rights Act: The US Department of Justice (DOJ) filed an amicus brief [ [link removed] ] in Louisiana’s redistricting case, known as Louisiana v. Callais, that argued for a “radically narrowed interpretation of Section 2” of the Voting Rights Act (VRA), a significant change from the DOJ’s history of being a proponent of Section 2 of the VRA. The DOJ’s brief claimed that Louisiana’s creation of a second majority-Black congressional district was “unconstitutional” and that “Section 2 does not supply a compelling interest to draw such districts because the statute would be unconstitutional if it required such race-based districting.” The DOJ also asked the Supreme Court to participate in oral arguments for the case, currently scheduled for October 15.
DOJ Continues to Escalate Effort to Obtain States’ Voter Data By Suing 6 More States: The DOJ announced [ [link removed] ] that it had filed lawsuits against six states– California, Michigan, Minnesota, New York, New Hampshire, and Pennsylvania – for refusing to provide their statewide voter registration lists after the DOJ requested them. This announcement came a week after the DOJ sued Maine and Oregon [ [link removed] ] for also refusing to turn over their voter registration data.
YouTube to Reinstate Accounts Banned for Election Misinformation: In a letter submitted in response to subpoenas from the House Judiciary committee, Alphabet, YouTube’s parent company, stated that YouTube will allow [ [link removed] ] creators who were banned for violating election and COVID-19 misinformation policies, which are no longer in effect. “No matter the political atmosphere, YouTube will continue to enable free expression on its platform, particularly as it relates to issues subject to political debate,” the letter read. YouTube’s move is the latest in efforts from tech companies to rollback content moderation policies.

STATE ACTIVITY
Texas • Counties Struggling to Process Thousands of Voter Registrations Ahead of October 6 Deadline for November Elections Due to Updated System: County election officials across Texas have reported issues [ [link removed] ] with an update to the state’s voter registration system, known as TEAM, that has led to tens of thousands of voter registrations stuck in limbo. The state overhauled the TEAM system in July and county election officials reported numerous issues with the software, including voting precincts not populating correctly and registration information not saving at all. Due to the issues, there are tens of thousands of registration applications that have not been processed across the state including 13,000 in Tarrant County, 12,000 in Travis County, and more than 40,000 in Bexar County, home to San Antonio. There is an October 6 deadline to register to vote for the November constitutional amendment election, and voters whose registration applications were received on time but not processed by the time of the election must cast a provisional ballot.
ANTI-VOTING GROUP ACTIVITY
Republican National Committee Is Working “Hand-In-Glove” With President Trump to Implement His “Election Integrity” Agenda: The Republican National Committee (RNC) is working [ [link removed] ] to implement President Trump’s “election integrity” agenda ahead of the 2026 midterms. The RNC has filed litigation to enact election policies that Trump’s March executive order tried to implement, such as requiring mail ballots to be received by Election Day to be counted. “We are challenging these things on a state-by-state basis to make sure that they are compliant with the statutory schemes as constructed now, and that they provide the most balanced security as we can have in those states,” a RNC official told The Daily Signal, a conservative news site. The official went on to claim that the RNC has “dozens and dozens of lawsuits already.”
