You may have heard of the U.S. Supreme Court’s “shadow docket” — it’s when the Court issues emergency rulings in urgent cases outside of its normal schedule, usually without full briefings and oral arguments.
This shadow or emergency docket is how the Trump administration is getting so much of its agenda accomplished despite lower court rulings to stop it, with less transparency from justices around the reasoning for their decisions.
When the Court rules in Trump’s favor, he can temporarily carry out his actions while the case continues to move through the legal process until reaching a final decision, which could take a year or even longer.
So far in Trump’s second term, his administration has won 84% of its emergency appeals to the Court — a much higher success rate than President Joe Biden’s administration, which only won 53% of the time, according to The New York Times.
Trump isn’t just winning these appeals more often – his administration is filing them at a drastically higher rate than previous presidencies.
It’s all part of the MAGA strategy: flood the zone with unconstitutional executive orders and actions that trample on people’s rights, then immediately appeal to the Supreme Court when they’re stopped by lower courts.
