Public Notice: Notice of Intent to Adopt Rules - WY EQC, 11/18/2025
The Wyoming Environmental Quality Council will consider proposed revisions to the Wyoming Department of Environmental Quality (WDEQ), Land Quality Division (LQD) Noncoal Rules Chapter 6 – Financial Assurance and Source Material Program Rules Chapters 1 through 9 at a hearing to be held at 9:00 a.m. (MST) on November 18, 2025. The proposed revisions to LQD Noncoal Chapter 6, Docket #25-4102, were drafted in response to 2025 WY House Bill 0041 which granted the LQD authority to accept irrevocable letters of credit issued by credit unions organized to do business in the United States. Noncoal Chapter 6 was also revised to clarify which institutions insure irrevocable letters of credit issued by banks and credit unions.
The proposed revisions to LQD Source Material Program rules, Chapters 1 through 9, Docket #25-4103, were drafted in response to the Nuclear Regulatory Commission’s (NRC) comments on the WDEQ Draft Application for an Agreement for the regulation of source material filed January 10, 2025. The NRC provided comments on the draft application, including the proposed revisions to the SMP rules as promulgated on January 3, 2025. The proposed revisions are intended to address those comments.
The proposed rules in Dockets # 25-4102 and #25-4103 meet minimum substantive state statutory requirements per Wyoming Statute (W.S.) § 16-3-103(a)(i)(G). Individuals with questions regarding the rulemaking may contact Craig Hults at (307) 777-7066 or
