Earthjustice Back in Court After Trump Scraps Agreement to Save Pacific Northwest Salmon

Earthjustice is heading back to court after the Trump administration abruptly scrapped a landmark agreement to save endangered salmon in the Columbia Basin.

The Resilient Columbia Basin Agreement, signed in late 2023, was a historic partnership between the federal government, Oregon, Washington, four Columbia Basin Treaty Tribes, and Earthjustice plaintiffs. Put simply, the agreement brought all the stakeholders together and may have put us on a path to breach the four dams on the Lower Snake River, where every salmon run is currently endangered. Without the important progress achieved through this agreement, the salmon have virtually no chance of recovery.

This case is not just about salmon — it’s also about justice and a way of life. The Trump administration’s decision to tear apart this carefully crafted agreement is another dark chapter in the federal government’s history of betraying Tribes. And the salmon it seeks to restore are key to the region’s ecosystem, economy, and Tribal culture.

So Earthjustice, joined by states, Tribes, and environmental allies, is asking the U.S. district court in Oregon to lift a litigation pause that had been in place under the agreement. Once again, we are going to court for the Snake River.

Lawsuit Filed: Challenge to the Illegal Extension of J.H. Campbell Coal Plant
As we write this, the Trump administration is forcing an aging, dirty coal power plant to continue burning coal even though the electricity is not needed — costing ratepayers in Michigan and surrounding states as much as $1 million per day.

Earthjustice is suing to close the plant, which was scheduled to be shut down months ago by the utility. More than enough replacement power has been secured, and yet the Trump administration is issuing fake “emergency” orders to keep the plant running.

For example, on June 23, when the Trump administration claims the coal plant’s electricity was needed, there was surplus energy 10 times greater than what the plant produces.

The Trump administration is ripping off the American people and making climate change worse through illegal emergency declarations. We’re taking them to court.

Lawsuit Filed: Challenging Trump EPA Backtracking on Slaughterhouse Pollution
The slaughterhouse industry dumps millions of pounds of waste into our waterways every year. Sixty million people live within a mile of rivers and streams that have been degraded by slaughterhouse pollution, which includes blood, fecal bacteria, pathogens, nitrogen, and phosphorous.

But now, the Trump administration is throwing out new rules planned by the Biden administration that would have eliminated at least 8 million pounds of phosphorous waste — which leads to algal blooms and dead fish — and 9 million pounds of other waste.

Earthjustice and the Environmental Integrity Project, along with a coalition of 10 organizations, are suing to reinstate the rule.

The rule in question was hard-won, and Earthjustice lawsuits in 2019 and 2022 compelled the EPA to create it. Your support allows Earthjustice to fight multi-year legal battles that force the government to protect people instead of slaughterhouse profits.

Lawsuit Filed: Conservation Groups Sue EPA Over Reversal on West Virginia Haze Plan

In a dramatic reversal, the EPA has approved West Virginia’s regional haze plan — despite previously rejecting it in full. This decision is another Trump administration giveaway to polluters at the expense of our environment, so alongside our clients Sierra Club and National Parks Conservation Association, we’re suing.

Lasting approval of the plan would mean that preventable air pollution will continue harming public health and blurring scenic views of landscapes at prized national parks and wilderness areas across the eastern U.S. and beyond.

The agency’s endorsement of the plan is a far departure from its long-standing interpretation of the Clean Air Act and regional haze regulations as well as a complete about-face from its previous disapproval of the plan. The reversal is not just unlawful — it’s a betrayal of decades of progress. But thanks to your support, we will fight back in court and overturn this harmful decision.
