We won, friend!
This morning, in our case with the Institute for Constitutional Advocacy and Protection (ICAP) and the National Center for Youth Law (NCYL), we secured a massive victory on behalf of hundreds of vulnerable immigrant children.
As you might remember, the Trump administration, in the middle of the night on a holiday weekend, attempted the indefensible: waking vulnerable children up from their beds in shelters in Texas and Arizona and trying to unlawfully remove them to danger. Within hours, we filed an emergency lawsuit, and the court intervened just in time, as at least 76 frightened children sat on planes on airport runways.
Today, a federal court ruled that the Trump administration is now prohibited from removing our lawsuit’s class of children from the country while our case moves forward. The protection covers all Guatemalan unaccompanied children in the custody of the Office of Refugee Resettlement (ORR) who have not received a final order of removal or permission to voluntarily depart under applicable law.
Significantly, the court made clear that the government “should not construe this decision as an invitation to take similar action with respect to” unaccompanied children from other countries. This is a critical message given alarming reporting that the Trump administration wants to target unaccompanied children from other countries in the same manner.
Friend, thank you. You stood with us every step of the way, and your support of our work helped make this legal victory possible. But our fight is far from over. We will continue to litigate this case and advocate in Congress to hold the administration accountable.
Whatever this administration attempts next, and as our case moves forward, we will do everything in power to protect our clients and fight for the best interests of all immigrant children.
