Over Labor Day weekend, in the dead of night, 76 unaccompanied Guatemalan children were awoken and put on planes to deport them back to Guatemala, where they would face abuse and violence. This was in clear violation of their due process rights and was thankfully blocked by a federal judge, as one plane had already taken off and was forced to turn around back to U.S. soil.1
Kica Matos, president of the National Immigration Law Center—and one of CHN’s coalition partners—issued a statement:2
“What makes this case stand out in the most egregious ways is that our government in the dead of night ordered the shelters to wake these children up between 2:00 and 4:00 in the morning to put them on buses so that they could be transported to Texas, the airport, loaded on planes and deported to Guatemala without making sure that these kids avail themselves of the legal protections and the constitutional rights that they have.
Now, understand, none of these kids had received a final deportation order. These are kids whose cases are going through the system. And our government decided that they were going to simply yank away these legal and constitutional protections and send them to Guatemala.
The youngest kid that we spoke with is 7 years old. These are all unaccompanied children who are particularly vulnerable. That is what makes this case so outrageous.”
Of course this is hardly the only case of the Trump administration flouting the law and wreaking havoc. Recently, a federal judge ruled that Trump’s deployment of the National Guard to Los Angeles—against the wishes of California Governor Gavin Newsom—was a violation of the Posse Comitatus Act.3 But that’s not stopping Trump from federal overreach in Washington, DC, and threatening to federalize the National Guard and send them to Chicago, Baltimore, and elsewhere, against the wishes of governors.4
