Yesterday, 15 children in Wisconsin took a bold stand by filing a constitutional lawsuit ([link removed]) against the Wisconsin Public Service Commission and the Wisconsin Legislature.
These young people—ages 8 to 17—are fighting to overturn laws that promote fossil fuel pollution while obstructing clean energy. They’re demanding their government and the courts protect their future and the rights the Wisconsin Constitution promises them:
The right to life. The right to safety. The right to a stable climate.
Leveraging our expertise and groundbreaking victories, Our Children’s Trust is proud to represent these young plaintiffs pro bono. Working with local Wisconsin counsel and partner Midwest Environmental Advocates, we’ve brought Dunn v. Wisconsin Public Service Commission ([link removed]) to challenge laws that:
* Ban regulators from considering climate and air pollution when approving fossil fuel power plants
* Prevent regulators from increasing the amount of electricity Wisconsin gets from renewable energy sources
* Perpetuate a fossil-fuel-dominated electricity sector that violates Plaintiffs’ rights to life, liberty, and the use of Wisconsin’s waters

The contradiction is stark. Wisconsin committed to decarbonize its electricity sector by 2050, yet over 75% of its power still comes from fossil fuels—and these laws actively block the transition even when renewables are the cheapest form of energy today.
These 15 brave kids refuse to inherit a broken climate system. Their lawsuit could be a game-changer by restoring the power of public agencies to address climate pollution and defend the constitutional rights of youth throughout Wisconsin.
