PENNSYLVANIA
Earlier this month, a shocking report broke revealing that a sex offender in Pennsylvania was able to adopt a child because of a strange loophole in the law related to surrogacy. According to a local news report:
"Though traditional surrogacy is treated like an adoption in Pennsylvania and includes criminal background checks and clearances, that’s not the case for gestational surrogacy — where the surrogate mother carries a lab-created embryo using donor egg and sperm, often through in vitro fertilization."
Pennsylvania Freedom Caucus member, State Rep. Aaron Bernstine, immediately sprang into action and announced he was writing legislation to close the loophole. From the article, "[Bernstine] said he already received bipartisan support and will contact the Democratic majority leadership in the House toward fast-tracking the bill, which he expects to introduce within days."
It's horrendous that this adoption happened in the first place, but we have alerted all 13 of our state freedom caucuses to see if such a loophole exists in their states so we can file similar legislation. Our hope is that we can quickly pass this into law—regardless of which party is in control of these respective state capitols—so that innocent children are protected.
