There has been some misinformation about the fundamental right of due process that’s guaranteed by the U.S. Constitution.
I may do TikTok dances from time to time, but I am a lawyer and I know a thing or two about the legal system. I’ve even argued before the Supreme Court.
The 5th Amendment to the Constitution explicitly says “no person shall … be deprived of life, liberty or property, without due process of law.” Simply put, “due process” guarantees that you will not be arbitrarily fined, arrested, or deported — and that you must know the reason officials have targeted you.
You must also have an opportunity to contest those allegations before a neutral third party.
That’s not how it’s currently working in Trump’s America. Masked ICE agents are abducting people directly off the street, detaining them, and shipping them off — sometimes to a foreign prison. Not once were the victims of this tyranny — and it IS tyranny — afforded their right to due process.
Right now, the administration’s targets are immigrants, but history tells us that it won’t stop there. All of us are at risk, whether you’re a citizen or not. That’s why it’s more important than ever to know your rights.

We need to make sure everyone knows their rights. Due process is a fundamental constitutional protection to ensure that all of us can maintain our life, liberty, and our property — regardless of who we are or where we come from.
Our country was founded on the idea that the government cannot arbitrarily take away your rights and liberties — and that everyone has a right to defend themselves. That really means everyone. The word “person” in the 5th Amendment makes no distinction between citizens and noncitizens.
