Notice of Intent to Adopt Rules
The Wyoming Environmental Quality Council will consider proposed revisions to the Wyoming Department of Environmental Quality, Land Quality Division (LQD) Coal Rules Chapter 12 – Procedures Applicable to Surface Coal Mining Operations at a hearing to be held at 1:00 p.m. (MST) on September 17, 2025, at the Eastern Wyoming College, Board Room, 3200 West C Street, Torrington, Wyoming 82240. The proposed revisions to LQD Coal Chapter 12 were drafted as a state initiative and are intended to recognize a specific type of reclamation bond estimate adjustment that would not be considered a bond release request. The LQD is proposing to allow for a bond reduction request based on a decrease in the volume of material required to reclaim the final cut, pit, or void created at a surface mining operation.
The proposed rules in Docket # 25-4101 meet minimum substantive state statutory requirements per Wyoming Statute (W.S.) § 16-3-103(a)(i)(G).
