Dear John,

All workers deserve safe workplaces, free from harassment and discrimination. That’s why we’re suing the Trump administration’s Equal Employment Opportunity Commission (EEOC). For 60 years, the EEOC has acted as an independent agency to ensure equal opportunities for workers in the U.S. But, now, under the leadership of Acting Chair Andrea Lucas, the EEOC has capitulated to the unlawful policies of the Trump administration and abandoned transgender and nonbinary workers, leaving them vulnerable to harassment and abuse just for existing at work.
So we’re taking them to court. We, along with Democracy Forward, are representing FreeState Justice, Maryland’s oldest statewide legal services nonprofit working to improve LGBTQ+ lives in the state. The EEOC is supposed to protect workers from discrimination, but now it is refusing to even investigate certain charges of discrimination filed by trans and nonbinary workers, preventing FreeState Justice from being able to help their clients enforce their rights. The EEOC enforces federal workplace anti-discrimination laws, including those that protect against sex discrimination, which includes discrimination based on gender identity. But the EEOC’s Acting Chair Andrea Lucas—following Trump’s directives—has instructed the agency to turn its back on transgender and nonbinary workers. The EEOC moved to dismiss several lawsuits it brought on behalf of these workers, without any warning, and adopted a nonenforcement policy, essentially foreclosing the ability of transgender and nonbinary workers to benefit fully from EEOC’s charge investigation process.

That’s why we’re fighting back.

All workers around the country count on the EEOC to uphold civil rights in the workplace. The Supreme Court has made clear that our civil rights laws protect transgender and nonbinary workers from discrimination, including harassment, but under this administration, these workers are being left behind. We will fight against the Trump administration attacking workers under the guise of protecting women.
