   One dangerous provision is off the table – for now.
   Over the weekend, the Senate parliamentarian struck down a harmful
   provision in the GOP’s budget bill that would have required plaintiffs to
   post prohibitively expensive bonds just to obtain a preliminary injunction
   in court. That’s the first step in blocking this bill from advancing
   through the budget process, but the fight is not over. Republicans could
   still try to vote to overrule the parliamentarian so we must remain
   vigilant and keep the pressure up.
   Keeping this provision out of the bill will be a win for access to justice
   and a reminder that not every attack gets a rubber stamp. So we need to
   keep pressing until the very end.
   And make no mistake: Republicans’ broader assault on the federal judiciary
   will continue.
   Just one example: Congressional Republicans are pushing a separate,
   stand-alone bill, the so-called “No Rogue Rulings Act” (NORRA), which
   would restrict federal courts from issuing nationwide injunctions – even
   in cases of widespread government abuse or clear constitutional
   violations.
   At the same time, Senate Republicans are pressing forward with the
   confirmation of Trump’s judicial nominees. These individuals are
   hand-picked for their loyalty to Trump and their disregard for judicial
   independence.

   The week ahead could be one of the most dangerous yet for the independence
   of our federal courts.
   Senate Republicans are escalating their coordinated assault on the
   judiciary – moving to confirm and hold hearings on Trump’s judicial
   nominees picked for their loyalty to Trump, not the law and advancing
   legislation that would gut the power of judges to stop unlawful government
   actions. It’s a multi-pronged effort to strip the courts of their
   independence and authority and help Trump consolidate power.
   Next week, the Senate Judiciary Committee is expected to vote on Trump’s
   first slate of judicial nominees – while holding another hearing to
   advance even more. At the same time, the full Senate could move forward on
   the Republican budget bill, which includes a dangerous provision that
   would make it harder for judges to issue injunctions unless plaintiffs can
   post a prohibitively expensive bond.
   This is a coordinated effort to undermine access to justice from our
   courts while empowering Trump.
   Let’s be absolutely clear: the Senate should not be confirming any of
   Trump’s judicial nominees. Not while his administration is openly hostile
   to judicial independence. Certainly not while he and his cronies continue
   to smear judges who rule against him. And not while Republicans are trying
   to gut the courts’ ability to check unlawful government actions.

   Federal judges have ruled against Trump’s administration in case after
   case – not out of partisanship, but because his actions are unlawful.
