Email from Wisconsin Institute for Law & Liberty Upholding Freedom, Advancing Equality: A Week of Real Impact Last week, WILL filed a complaint on behalf of Spencer Wimmer, a devout Christian, who was fired by Generac Power Systems, Inc. (“Generac”) after sharing his Christian beliefs on gender identity with his manager and Generac’s HR department. Wimmer’s faith does not allow him to deny the existence of two sexes or affirm gender transitions. After Generac learned that Wimmer’s religious beliefs conflicted with the company’s expectation that he refer to transgender employees by their preferred names and pronouns, Wimmer was disciplined and terminated—even though Generac had not received any employee complaints about Wimmer. Prior to termination, Wimmer believed he would have a long-term career with Generac, having earned glowing performance reviews, merit-based raises, and multiple promotions into a leadership role. He lost his job after almost 5 years of dedicated service. I was heartbroken by the way Generac treated me, dismissing my religious convictions simply because they do not agree.” Watch Spencer's Story Here Trump Administration Ends Massive $37 Billion Dollar Discriminatory Program The Trump Administration admitted today in court filings that the largest and oldest affirmative action program in U.S. history is unconstitutional. This move comes on the heels of a successful legal challenge by WILL, who secured an injunction in 2024, against the illegal "disadvantage business enterprise" (DBE) program. WILL originally sued the Biden Administration on behalf of our two clients, Mid-America Milling Co., LLC (MAMCO) and Bagshaw Trucking Inc., alleging race- and sex-based discrimination. In 1980, the DBE program began as a multi-billion-dollar set-aside program for minority- and women-owned roadbuilding and construction businesses, typically covering 10% of the federal government’s entire budget for transportation spending. The program was most recently funded with $37 billion in tax dollars under the “Biden Infrastructure Bill.” WILL Vice President and Deputy Counsel, Dan Lennington, stated, “Over the past five decades, the federal government imposed a policy of race discrimination in the roadbuilding industry. Thousands of workers and small businesses have been victimized, and hundreds of billions have been spent, distorting the market and inflating construction costs for taxpayers. That ends now. Following WILL Lawsuit, Trump Administration Launches Investigation into Green Bay School District The U.S. Department of Education’s Office for Civil Rights (OCR) has opened an investigation into the Green Bay Area Public School District (GBAPS) for discriminating against a dyslexic student based on his race. WILL filed the complaint with OCR on behalf of Colbey Decker, a mom from Green Bay, Wisconsin, whose dyslexic son was denied reading resources because of his race. The GBAPS admitted this practice through its “School Success Plan,” where they explicitly stated that the school will prioritize some racial groups over others. This message was conveyed directly to Mrs. Decker by a school principal during an in-person meeting. WILL Client, Colbey Decker, stated, “Why was my son treated differently for something completely outside his control—his race? It’s outrageous that this happened at all—yet it did—to my son last year. I’m grateful to the Trump Administration and Department of Education for opening an investigation. Watch the Decker Family's Story WILL Report: Slashing Red Tape is Key to Solving Wisconsin Childcare Crisis WILL, in partnership with the Archbridge Institute, released a new report titled, “Reforming Childcare in Wisconsin: Reducing Regulatory Burdens to Expand Access.” The report reveals Wisconsin’s ranking as the 10th most restrictive state for childcare regulations, even lagging states like California, Illinois, and Michigan. In Wisconsin, families are burdened by an average monthly childcare cost of $915 per child, a staggering 17% of the median household income for families with young children. Nearly 80% of women and almost 25% of men who leave the workforce do so to provide necessary home and childcare. WILL aims for this report to show how excessive and unnecessary regulations strangle childcare options, drive-up costs, and exacerbate Wisconsin’s skilled worker shortage. We are also calling on Wisconsin policymakers to prioritize regulatory reform to expand access to affordable, quality childcare.
