We have wonderful news to share with you. Yesterday, we successfully blocked the Trump administration from disappearing our client, who ICE baselessly claims is a member of the Tren de Aragua gang, under the “Alien Enemies Act.”
Our client, a Venezuelan asylum seeker using the initials Y.A.P.A. for his own safety, has been in ICE detention since February. As he watched other Venezuelans get whisked away in the dead of night, Y.A.P.A. has lived in constant fear that he too would be moved from the United States to CECOT, El Salvador’s notorious maximum-security prison.
He faced disappearance to CECOT without due process based on ICE’s allegations, with no evidence, of gang affiliation. Thanks to yesterday’s ruling, that won't happen for now.
The judge who ruled in our favor perhaps summed it up best, saying:
“The public interest, while not always vocalized the loudest, requires that we remember that that these constitutional protections do not exist only for those attending lunch at the local Rotary Club, enjoying war stories at the VFW hall or having a beer at the Moose Club lodge. These rights are not rationed based upon political views, and they do not belong solely to those who may be subjectively determined to be great Americans… This foundational principle is part of what has made, and will continue to make, America great.”
