On Friday the Supreme Court made indefinite its block on the Trump administration from deporting certain Venezuelan migrants quickly under the Alien Enemies Act of 1798, report Josh Gerstein and Kyle Cheney of Politico [link removed].
The justices extended a previous pause on deportations from a north Texas detention center after an emergency appeal from the lawyers of two Venezuelan men. The underlying case continues in lower courts, as do other lawsuits regarding use of the law.
Elsewhere in rule-of-law and due-process news, experts across the country are flagging an increase in suspects’ deportations before they have a chance to stand trial, reports Trevor Hughes of USA Today [link removed].
"It's not only undermining to the justice system but also impacting community safety," said Adams County (Colorado) District Attorney Brian Mason.
Prosecutors, judges, defense attorneys and others point out that the practice makes it more difficult for victims to get closure and justice, as well as preventing people innocent of a crime from clearing their name.
