The tax reconciliation bill, moved forward today by the House Ways and Means Committee, contains a troubling provision: the US treasury secretary would be given unilateral power to strip an organization’s 501c3 nonprofit status without due process if the secretary decides that the organization supports "terrorism."

In a Nonprofit Quarterly article, nonprofit leaders explain that the provision is “a direct assault on organizations that serve the most vulnerable Americans, stepping in to provide support in overlooked communities.”

In a statement from the American Civil Liberties Union, Kia Hamadanchy said: “It is not a stretch to imagine how this bill could be used to pressure universities to shut down student groups, scare human rights organizations away from working with vulnerable communities, and further stifle dissent in this country.”

Such a provision would have a strongly negative effect on Migrant Clinicians Network’s ability to provide services to our underserved constituents. We invite our MCN community to learn more about the proposed bill and to take action.

Take Action: Call your representatives to let them know to reject this provision. Here is some text, taken in part from the Georgia Center for Nonprofits (GCN)’s advocacy on this issue.

Sample phone/email message for you to customize, for your representative:

Hello, my name is _____ and I am from ____, zip code ______. I am calling/emailing to ask you to reject the Section 112209 provision in the tax reconciliation bill. This provision would grant the Treasury Secretary the ability to revoke the nonprofit status of an organization without due process.

While I strongly oppose terrorism and support efforts to protect national security, this measure lacks clear definitions and essential due process safeguards. It opens the door to political abuse, targeting of advocacy groups, and a chilling effect on vital community services – especially for nonprofits serving marginalized populations or engaging in policy advocacy.

Nonprofits are already highly regulated and fully transparent via IRS filing and public reporting requirements. This new authority is unnecessary, dangerous, and counterproductive.

I urge you to strike this provision from the reconciliation package to prevent irreversible harm to our nation’s civil society and democratic institutions.
