Despite having already been elected president two times, constitutionally prohibiting him from being elected for a third time according to the 22nd Amendment, President Trump has repeatedly suggested that he would attempt to extend his time in office beyond his current term.

So in March, CREW filed a Freedom of Information Act request to determine whether the Department of Justice has provided legal opinions about whether any president can extend his term beyond the understood constitutional limits.

And now, we’re suing the DOJ for all records of its opinions, memos or analyses issued by the Office of Legal Counsel about the 22nd Amendment.

Because no matter what Trump says, he cannot be elected to a third term— and we’re going to ensure the Constitution is enforced.

John, Section 1 of the 22nd Amendment is clear: no person shall be elected to the office of the President more than twice.

But Trump thinks he’s above the law and seems to want to treat presidential term limits as negotiable.

That’s why CREW is taking action. Term limits are a key tool that prevent our democracy from becoming a monarchy. They are not optional.

We believe that the public deserves access to any documents and memos that provide further clarity on the issue. As the Office of Legal Counsel provides legal advice to the president and all agencies within the executive branch, the OLC’s views on this subject carry great weight.
