PA Dems, With the Support of the DNC, Files Opposition Brief in US Supreme Court to Protect the Rights of Pennsylvania Voters
Republicans are trying to supersede the jurisdiction of the PA Supreme Court, end PA voters’ right to cast provisional ballots on Election Day
Today, the Pennsylvania Democratic Party, with the support of the DNC, filed an opposition brief in the US Supreme Court to protect the rights of PA voters to have their vote counted.
The RNC and Pennsylvania Republicans attempted to end long-standing law in Pennsylvania that allows Pennsylvania voters who voted early by mail but have errors on their mail-in ballot to cast a provisional ballot in-person on Election Day to ensure their vote is counted. The Pennsylvania Supreme Court ruled against Republicans in October and now, Republicans are trying to supersede the long-standing sovereignty of the Pennsylvania Supreme Court and bring this case to the US Supreme Court.
Democrats are fighting back, filing an opposition brief in this case, for two reasons:
1. Pennsylvania voters deserve to have their votes counted if a simple error on their mail-in ballot occurs.
2. The Pennsylvania Supreme Court has ultimate jurisdiction in this case and change in that precedent would invalidate State Supreme Court sovereignty over voting rights cases across the country.
With important judicial retention races coming up in November, the DNC is fighting for the rights of every Pennsylvania voter.
DNC Chair Ken Martin issued the following statement:
“Pennsylvanians deserve to have their votes counted in every election – full stop. Simple errors on mail-in ballots shouldn’t impede Pennsylvanians from exercising their rights at the ballot box. The Pennsylvania Supreme Court agrees, which is why they ruled that all Pennsylvanians who submitted disqualified mail ballots must have the right to cast, and have counted, provisional ballots on Election Day. Now, the Republican Party is trying to upend state sovereignty and end this practice, all based on obscure and debunked legal theories. The DNC is standing up for Pennsylvania voters because the stakes are too high not to fight back.”
Pennsylvania Democratic Party Chair Sharif Street issued the following statement:
“Pennsylvania is the birthplace of American freedom and democracy and the DNC is fighting to ensure that Pennsylvania voters have their votes counted. Pennsylvania Republicans are trying to game the vote in their favor and that’s why they’re trying to upend Pennsylvania’s sovereignty and end long-standing voting practice in the state. With important Pennsylvania elections in November and in 2026, the DNC isn’t taking anything to chance when it comes to winning back the state. Pennsylvania will continue our fight with every resource we have – because the stakes are too high.”
