Landowners in South Dakota won a HUGE victory on Tuesday, when the South Dakota Public Utilities Commission (SD PUC) sided with them and *denied* Summit Carbon's CO2 pipeline permit application! [1]
Attorney Brian Jorde represented landowners with the South Dakota Easement Team before the SD PUC, and the Commissioners sided with our arguments that Summit had come forth with no plan, and no viable path forward to obtain the easements it needed from landowners in the state -- without eminent domain.
The victory was hard-fought by landowners across years of organizing, who pressed their county commissioners to pass commonsense ordinances, voted out unfriendly state legislators, led a petition initiative and won a historic victory at the ballot, leading to the Governor's signing into law a ban on eminent domain for carbon pipelines in the state.
Despite these obstacles, Summit continues to claim it will seek a path forward with its proposed multistate CO2 pipeline -- but due to landowners' perseverance, there is no conceivable route through South Dakota!
Meanwhile in Iowa, landowners are pressing the State Senate to pass a bill similar to South Dakota's, which would ban the use of eminent domain for CO2 pipelines in the Hawkeye State.
Landowners from South Dakota, Iowa, and eight other states recently traveled to D.C. to urge their members of Congress in person to scrap the federal 45Q tax credit that offers billions in taxpayer dollars to fund Carbon Capture & Storage (CCS) and CO2 pipeline schemes.
