** The State of Sanctuary in NYC

** On Monday April 21, a New York court issued a TRO ([link removed]) preventing the Adams administration from moving forward with their plan to give ICE office space at Rikers. Getting to this moment took a lot of work. Thank you for supporting IDP’s work to protect sanctuary.

A decade ago, IDP was instrumental in ensuring New York City passed historic sanctuary laws. As a result, city law prohibits the police, probation, and corrections department from using city time and resources to do ICE’s dirty work. Sanctuary laws are the promise that the city is not engaged in civil immigration policing, a promise which keeps our communities safe.
Earlier this month, news broke ([link removed]) that Mayor Adams and Deputy Mayor Mastro made good on the mayor’s promise to the Trump administration to give ICE an office space on Rikers Island by issuing an Executive Order (EO). This came after multiple meetings between the Mayor and Tom Homan ([link removed]) , the “border czar” charged with carrying out Trump’s mass deportation agenda.
If implemented, the EO would pave the way for ICE to separate more New Yorkers from their loved ones. IDP has worked quickly and tenaciously to respond, drawing on our long history of supporting sanctuary in New York city and working closely with many of our partners fighting for immigrants, people accused of crimes, domestic violence victims, and workers.
We led a press conference ([link removed]) outside City Hall to reject the executive order together with immigrant justice advocates, organizers seeking to shut down Rikers, the Speaker of the City Council and elected leaders.
We also worked with the Chair of the Immigration and Criminal Justice Committees in the Council to publish a letter to the Mayor ([link removed]) rejecting his order and standing with our sanctuary laws. The letter was signed by thirty City Council members, as well as the Public Advocate, the Comptroller, and the Manhattan, Queens and Brooklyn Borough Presidents. And we advocated for the City Council to pass a resolution ([link removed]) which greenlit legal action.
On Tuesday April 15, the Speaker and City Council brought suit against the Mayor and his administration ([link removed]) , challenging their plan. We applauded ([link removed]) this action to stand up for everyone in our community and resist dangerous fear-mongering and scapegoating. Less than a week later, a New York judge issued a temporary restraining order prohibiting the administration from taking any steps towards installing ICE at Rikers Island at least until a scheduled hearing this Friday April 25. The case is not yet over, but for now, our city remains a sanctuary.
Protecting and expanding sanctuary is a key priority of the Immigrant Defense Project.
