This is not just one case—it is a dramatic leap in fascist consolidation. As Georgetown law professor Stephen Vladeck warned, the assertion that “the government can disappear people to a foreign country with no due process and no responsibility for what happens next” amounts to “a rule-of-law crisis.” If they can do it to Abrego Garcia, they can do it to anyone.
Ezra Klein put it bluntly today in the NY Times: “To the Trump administration, Abrego Garcia is not a mistake. He is a liability, and he is a test. A test of their power to do this to anyone. A test of whether the loophole they believe they have found — that if they can get you on a plane, they can hustle you beyond our laws and leave you in the grips of the kind of gulags they wish they had here.”
Trump intends to send those he hates to torture camps beyond the reach of U.S. law. This regime is asserting that it is above the law—and that Trump is the law. The courts have no army. With Trump’s fascists in control of Congress, there is no force within the ruling structures that can stop him. And as Trump threatens U.S. citizens—saying “The homegrowns are next”—we must see the writing on the wall and WE must be the force that stops him.
This is a five-alarm emergency. The stakes could not be higher. If Trump can defy the courts and disappear people with impunity, no one is safe. He is testing whether he can lock down fascist rule, create an American nightmare in which immigrants are demonized & locked away, due process is abolished, dissent is criminalized, and his power through brute force knows no bounds.
We must not wait. We must not normalize. We must not hope others will act in our place.
We must take to the streets in our thousands and millions. Through determined, sustained, nonviolent resistance, we must create the kind of political crisis in which Trump and his fascist regime cannot rule, cannot impose their program, and cannot remain in power.
This is the moment.
