Presidents have the power to create national monuments, not to destroy them. |
In his first term, President Trump tried to do just that when he signed two executive orders to rollback protections for Bears Ears National Monument and Grand Staircase-Escalate in Utah. Earthjustice challenged this action and successfully stalled it in court up until the Biden administration restored the monuments and enlarged Bears Ears. |
President Theodore Roosevelt signed the Antiquities Act into law in 1906, allowing all future presidents to establish swaths of protected land in the United States. Since then, all but three presidents have used it to protect treasured places from mining, drilling, looting, and industrial development. |
But all that could change with new attacks from this Trump administration that reconsider protections for cherished public lands currently shielded from extractive industries — including national monuments. We defended our national monuments before, and we’re ready to defend them again. |

These monuments are not only beautiful, but culturally and historically significant to local Indigenous peoples, military veterans, and business owners. In 2023 alone, visitors to national monuments generated $2.1 billion in economic output. |
Now, members of Congress are laying the groundwork to dismantle the Antiquities Act while the Trump administration tries to roll back widely popular monument protections. |
