AG Nessel Reaches Agreement with Troy Place Apartments Owner and Property Manager Over Heat Outage Allegations

*LANSING* – Michigan Attorney General Dana Nessel has reached an agreement with Troy Place Owner, LLC, and LR Management Services to avoid potential litigation related to allegations that tenants of Troy Place Apartments were without heat. The Department of Attorney General conducted an informal investigation into whether the Michigan Consumer Protection Act had been violated. The Assurance of Voluntary Compliance (AVC) was filed (PDF) [ [link removed] ] last month in the 30th Judicial Circuit Court in Ingham County.  

Troy Place Owner, the owner of the apartment complex, and LR Management Services, who served as property manager for Troy Place Apartments, were the subject of an investigation by the Department of Attorney General following a consumer complaint from a first-floor tenant alleging she had been without heat. On January 18, 2024, the City of Troy issued a Do Not Occupy order for the apartment complex due to the lack of a fully functioning heating system, frozen pipes, and elevator failures. Later that day, pipes within Troy Place Apartments burst, causing flooding on the first floor. The Do Not Occupy order was lifted on January 29, 2024, after the City of Troy was satisfied that the heating issues had been sufficiently remedied by repairs or replacements to the boiler heating system.  

As part of the AVC, Troy Place Owner and LR Management Services have agreed to take proactive steps to maintain functional boilers and improve communication with tenants in the event of future system failures. Additionally, to the extent not already provided, tenants residing on the first and second floors of Troy Place Apartments at the time will receive compensation equivalent to their January 2024 rent, and consumers on the third through sixth floors will receive compensation of $250.   

“Landlords and property managers have a responsibility to provide safe and livable conditions for their tenants,” Nessel said. “My office will continue to hold accountable those who fail to meet that obligation.”
