In one of his first moves in office, President Trump signed an executive order that was “blatantly unconstitutional.” According to NBC News, he sought to deny citizenship to children born in the United States whose parents are not citizens, which goes directly against the 14th Amendment in the U.S. Constitution.
This action was quickly and temporarily blocked by the courts. First it was a federal court in Seattle that blocked the President’s order for 14 days, and then a federal judge in Maryland issued a nationwide preliminary injunction further expanding that ruling. In most cases, a preliminary injunction stays in effect until the case is heard, or a higher court reverses the ruling. Without these checks and balances in place, politicians like Trump would be able to get away with wreaking havoc on our nation. However, we still have work to do: This case may end up in the Supreme Court. If the right-leaning Supreme Court justices allow the President to reinterpret lines in the Constitution, there is no telling what damage will be done over the next four years.
Courts matter. That is why we are sounding the alarm on critical judicial elections happening in PA this year that could play a big role in reshaping our Commonwealth. From voting rights to climate justice, education, health care, and much more, justices have the power to impact the day-to-day lives of Pennsylvanians, and we must prepare now to ensure that voters understand what’s at stake and are ready to turn out and make their voices heard.
With the new administration determined to strip away our rights, it’s more critical than ever before that we protect the independence of our state judiciary. State courts are the final arbiters of state laws and constitutions.
