The government found a new way to censor speech and sidestep the First Amendment -- by outsourcing its dirty work to "private" entities.

That's why the Center for American Liberty just filed a critical amicus brief in a case exposing this disturbing trend.

In Houston, Texas, the city handed over control of a public park to a "private" nonprofit organization.

Once in charge, the nonprofit restricted free speech in the park -- censoring opinions the city itself could not legally suppress.

This is a dangerous loophole. If the government can avoid the Constitution simply by handing off its responsibilities to private actors, then free speech in America is at serious risk.

  • Managing a public park is a government function.
  • A “private” nonprofit performing this function is effectively acting as the government.
  • Therefore, it cannot restrict speech in ways the First Amendment prohibits.
